Privacy Policy

In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, relating to the protection of individuals with regard to the processing of personal data and the free circulation of these data (in forward “RGPD”) and the Organic Law 3/2018, of December 5, on the protection of personal data and guarantee of digital rights (“LOPDGDD”), then Mutualidad provides information on the data processing carried out from the #MutuaTech platform (hereinafter the “Platform”).

This policy applies to the user who is registered as a user of the Platform (hereinafter “User”) and refers to the treatment of the data that will be collected and managed from the Platform in an integrated manner with Mutualidad’s systems.

RESPONSIBLE FOR THE TREATMENT

The person responsible for the treatment is the entity that has contracted the services provided by the Platform to use the services offered.

PURPOSE AND LAWFUL BASIS OF THE TREATMENT

The purposes and legal bases through which Mutualidad will treat the personal data of the Platform User are as follows:

To manage your registration and identification as a user of the Platform: In case you decide to register as a user on our Platform, we need to process your data to identify you as a user of the same and give you access to its different functionalities and services that are available to you as a user registered
Legal basis: the processing of data for your registration on the Platform of Mutuality is necessary for the execution of a contract (Article 6.1.b) of the RGPD), understood as the terms that regulate the use of the Platform.
Commercial communications: Mutualidad will process your data to send you the Mutualidad newsletter and its own commercial communications informing you of our products and services, as well as other events and activities linked to Mutualidad.
Legal basis: The treatment is carried out on the basis of your consent (article 6.1.a) of the RGPD).
Events: Mutualidad will treat your personal data for the management of registration for the events offered on the Platform, as well as to confirm that the requirements for registration and participation in the event are met and to keep you informed about news related to the celebration of the event.
Legal basis: The treatment is carried out on the basis of your consent (article 6.1.a) of the RGPD).
Profiling: Mutualidad will process your personal data for the purpose of profiling and thus being able to customize the commercial communications it offers you, having no other effect on the relationship with you.

Management of queries, complaints or claims: if you contact to raise a query, complaint or claim related to the Platform, your personal data will be processed to manage the query, complaint or claim.
Legal basis: the treatment of personal data will be carried out based on the consent of the User when sending the communication.
Compliance with legal obligations: the personal treatment of the User may be carried out in compliance with legal obligations imposed on Mutualidad such as, for example, communications to competent authorities in the event of inspections or administrative processes that require information from the User.
Legal basis: the treatment of personal data will be carried out based on a legal obligation imposed on Mutualidad.

ORIGIN OF PERSONAL DATA

The data can be collected directly from the User when using the features of the Platform or through the data that Mutualidad has associated with the User due to the contractual relationship that may unite them.

CONSERVATION OF PERSONAL DATA

Your personal data will be processed during the period of time necessary to fulfill the purposes described in this Privacy Policy and during the time necessary to meet the obligations imposed by the applicable laws, especially considering the legal prescription periods, and taking into account the formulation, exercise or defense of claims.

RECIPIENTS OF THE PERSONAL DATA

Depending on the purposes for which the personal information is collected, the following persons/entities can access said information, indiscriminately:

Authorized personnel of Mutualidad or its representatives acting on behalf of Mutualidad, subject to the applicable data protection laws;
Public administrations, regulatory authorities or other third parties in accordance with applicable laws;
Third parties (service providers that process information as data processors, under the instructions of Mutualidad). All this only after taking the necessary measures to ensure that we can share said information in compliance with the applicable data protection laws.

DATA PROTECTION RIGHTS

You have the right to:

Right to request access to personal data: you can check if Mutualidad processes your personal data, and if so, access them.
Right to request rectification if the data is inaccurate, or to complete data that is incomplete.
Right to request the deletion of your data.
Right to request the limitation of your treatment: in this case, your personal data will only be kept for the exercise or defense of claims.
Right to object to treatment: Mutualidad will stop processing your personal data, with the exception that they must continue to be processed for legitimate reasons or for the exercise or defense of possible claims.
Right to data portability: if you want your data to be processed by another controller, Mutualidad will facilitate, as long as it is technically possible, the transfer of your information to the new controller.
Right not to be subject to a decision based solely on the automated processing of your personal data. If you had granted consent for a specific purpose, you can withdraw it whenever you want, without it affecting the legality of the treatment based on consent prior to its withdrawal.

Likewise, whenever you consider it appropriate, you can submit a complaint to the Spanish Data Protection Agency (www.aepd.es).

ADDITIONAL INFORMATION

International transfers: Mutualidad through its providers carries out transfers of personal data outside the European Economic Area (EEA). These transfers are carried out in compliance with the applicable data protection laws. In particular, the providers with whom Mutualidad works meet one of these requirements: i) data processing is carried out in a territory that guarantees an adequate level of protection according to the European Commission; ii) the supplier has adopted binding corporate rules; or iii) a contract of standard clauses has been concluded with the supplier. Regardless of the place where your personal data is collected or processed, Mutualidad ensures and guarantees that the service providers maintain the appropriate technical and organizational security measures to protect the information about you.
Child Use Policy. The Platform is aimed exclusively at persons of age. In this sense and, consequently, Mutualidad does not deliberately collect information from minors. In any case, if you are a parent or legal representative and you consider that your child or guardian has sent us personal data, contact us by writing to proteccion.datos@mutualidad.com.
Updates The treatment of the personal data of the Users will be carried out in accordance with the provisions of the Privacy Policy that is in force at the time when the personal data of the User is collected. In the event that Mutualidad carries out a modification on the treatment of the data, you will be informed in due course.
